Once you’ve completed the purchase of a property in Mallorca, your ownership isn’t fully secure until it’s officially registered at the Land Registry. This step ensures legal protection, tax compliance, and access to financing or resale.
At Borderless Lawyers, we handle all post-sale registrations on behalf of our foreign clients — with or without Power of Attorney.
✍️ Step 1: Sign the Public Deed (Escritura Pública)
-
This takes place at a Spanish notary office
-
Both parties (or their legal reps) must be present
-
The final property deed is signed and notarized
💡 We attend the signing for you if you’re abroad using POA.
🧾 Step 2: Pay Property Transfer Taxes (or VAT)
For resale properties:
-
ITP (Impuesto de Transmisiones Patrimoniales): 8–11%, depending on price
For new builds:
-
VAT (IVA): 10%
-
Stamp Duty (AJD): 1.5%
✅ We calculate and pay these taxes on your behalf.
🗂️ Step 3: Submit to the Land Registry (Registro de la Propiedad)
Once the taxes are paid:
-
The notary sends a telegraph copy to the registry
-
We submit the full original deed
-
Registration usually takes 2–6 weeks
-
You receive a registered copy proving your legal title
🧾 Step 4: Update the Cadastral Registry (Catastro)
-
Required for local tax (IBI) and utility setup
-
Ensures alignment between cadastral and registry data
-
We notify the Dirección General del Catastro of the ownership change
📋 Required Documents
-
Original notarized deed
-
Proof of ITP or VAT/AJD payment
-
Buyer’s NIE and ID
-
POA if you purchased remotely
